The Occupational Disease Recognition Regulation of the Workers Compensation Act recognized plantar fasciitis as an occupational disease, with no presumption in favour of work causation. There was no policy direction on plantar fasciitis or the recognition of any risk factors.

At issue was a review of the medical and scientific literature to determine whether policy on plantar fasciitis should be created.
