When a worker is compensated for a compensable injury, he or she may also be compensated for a number of the consequences that flow from it. Policy identifies several types of consequential incidents that may not be so clearly connected to the employment-related injury, but which are still considered compensable. Policy also provides cost relief to employers by excluding some of the costs of these compensable consequences from an employer’s experience rating.

At issue was a review of the cost relief policies to determine if WorkSafeBC should provide cost relief to employers for the costs of a further injury, increased disablement, disease, or death that is the result of an unexpected or largely unpredictable subsequent incident that was accepted as a compensable consequence of treatment, surgery, Board-related assessment, or travel for exceptional treatment of a compensable injury.
