Discussion Paper - Notification of Decisions
WorkSafeBC policy in the Rehabilitation Services and Claims Manual, Volume II guided how and when decisions were communicated to workers and employers, along with whether reasons for the decision were provided. Policy also provided guidance on notifying workers and employers of their rights of review and appeal.
At issue was whether policy on Notification of Decisions should be revised to clarify that decisions could be communicated either verbally or in writing, and when the statutory time limitations commenced for the reconsideration and review provisions found in the Workers Compensation Act.
Also at issue was whether the Notification of Rights of Review and Appeal policy should be revised so that notification of rights of review and appeal were required on rejected claims.
