As a result of the 2003 legislative changes and a 2007 policy change to limit reconsideration of classification decisions, situations arose where WorkSafeBC could not change the classification of a firm, because the original decision was made more than 75 days in the past.

At issue was whether firm classifications should be assigned annually, allowing WorkSafeBC to correct past misclassifications for future assessment years.
