Discussion Paper - Loss of Earnings Assessments
At issue was a review of the loss of earnings assessment policy which established criteria for determining when the combined effect of a worker's pre-injury occupation and disability was “so exceptional” that a permanent disability award based upon the loss of function method was not appropriate.
The legislation and policy at time of consultation resulted from the Bill 49 legislative changes that came into effect on June 30, 2002. It was recognized at that time that a future review of the policy would be required given the significant changes to the loss of earnings legislation and policy.
Consultation closed October 31, 2007.
